1. Introduction & Acceptance of Terms

By accessing the Site, creating an account, or placing a reservation, you agree to be bound by these Terms and any policies referenced on the Site. If you do not agree, do not use the Site or services.

2. Eligibility and Age Verification

You must be legally able to enter into a binding contract and meet minimum age requirements for the equipment you request. Age eligibility is verified using Stripe Identity or other approved methods. We use the following age bands:

• Restricted (Under 21): generally not eligible to rent equipment.
• Limited (21–24): eligible only for equipment designated as Limited.
• Unlimited (25+): eligible for equipment designated as Unlimited.

We may deny or cancel reservations if verification fails, if information provided is incomplete or inaccurate, or if you do not meet the required age band for the requested equipment.

3. Rental Equipment and Availability

Equipment availability is not guaranteed. Listings, specifications, and images are descriptive and may vary based on actual inventory. We may substitute comparable equipment or cancel a reservation if the requested equipment becomes unavailable.

4. Reservations and Payments

Reservations are made online through the Site and are not confirmed until payment is successfully processed through Stripe Checkout. You authorize Gizmo.Rentals to charge your payment method for rental charges, deposits (if applicable), taxes, fees, and approved overages.

5. Cancellations, Refunds, and Fees

Cancellation and refund eligibility is stated at checkout and may vary by equipment type and lead time. Platform fees and payment processing fees are non-refundable. If a refund is issued, it will exclude any non-refundable fees and may be subject to other deductions described at the time of booking.

6. Equipment Pickup, Use, and Return

You agree to pick up, operate, and return equipment in accordance with the instructions and safety guidance provided. You are responsible for ensuring the equipment is used only by qualified operators and is returned on time, in clean condition, and with all accessories. Late returns may result in additional charges at the then-current rates.

7. Prohibited Uses

You may not use, or allow others to use, equipment in any of the following ways:

• Illegal, unsafe, or reckless operation.
• Use by unqualified, underage, or unauthorized operators.
• Operating under the influence of drugs or alcohol.
• Removal or disabling of safety devices or warning labels.
• Subleasing, lending, or transferring the equipment without written approval.
• Transporting hazardous materials or using equipment outside its intended purpose.

8. Damage, Loss, and Responsibility

You are responsible for loss, theft, misuse, or damage (including normal wear that exceeds reasonable use) during the rental period. You authorize Gizmo.Rentals to charge your payment method for repair, replacement, cleaning, towing, recovery, or other associated costs.

9. Assumption of Risk

Operation of rental equipment involves inherent risks, including serious injury or property damage. You assume all risks arising from use, transportation, loading, or storage of the equipment, whether by you or anyone you authorize.

10. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Gizmo.Rentals, its affiliates, and service providers from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the equipment or your breach of these Terms.

11. Limitation of Liability

To the maximum extent permitted by law, Gizmo.Rentals is not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or use, arising from or related to the Site or equipment rentals. Our total liability for any claim is limited to the amount you paid for the applicable rental, excluding non-refundable fees.

12. Insurance

Gizmo.Rentals does not promise or provide insurance coverage for renters. You are responsible for obtaining any insurance or coverage you deem necessary for your rental activities, and for confirming whether your existing policies apply.

13. Right to Refuse or Terminate Service

We reserve the right to refuse service, decline reservations, or terminate rentals for any lawful reason, including safety concerns, suspected fraud, non-compliance with these Terms, or failure to meet eligibility requirements.

14. Changes to Terms

We may update these Terms from time to time. Changes are effective when posted on the Site. Your continued use after changes become effective constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the state in which the rental occurs, without regard to conflict-of-law principles.
